Ditch Witch and Vermeer Settle HammerHead Suit, Share Distribution

On December 2, Earth Tool Company announced that a settlement has been reached between The Charles Machine Works, Inc. (CMW), Earth Tool Company, LLC (ETC), and Vermeer Corporation regarding litigation related to the purchase of ETC by CMW.

ETC’s products are marketed under the brand HammerHead Trenchless Equipment, including a complete line of HammerHead moles, HammerHead bursting products, HammerHead ramming tools, and HammerHead HDD tooling. In April of this year, CMW, the parent company of Ditch Witch, acquired ETC, which had previously had a close relationship with Vermeer.

Based on the terms of the settlement, HammerHead Moles will be available non-exclusively through Vermeer dealers for a period of two years and HammerHead HDD tooling will be available non-exclusively for three years. Parts will be available through Vermeer dealers for 15 years. In addition, these products are now available through authorized Ditch Witch dealers worldwide. HammerHead ramming and bursting products are available through select authorized dealers, as well as direct from ETC. All HammerHead trenchless equipment will continue to be manufactured in Oconomowoc, Wisconsin, where ETC headquarters are located.
