OSHA cites Birmingham contractor after trench collapse
(UI) — A U.S. Department of Labor investigation has found that a Birmingham-area civil construction company willfully exposed workers to trench collapse hazards at a Bessemer worksite in Jefferson County.
According to investigators with the Occupational Safety and Health Administration, employees of CB&A Construction LLC were removing and installing drain pipes under a suspended load without hard hats and while working at the edge of an excavation that lacked required protective systems.
OSHA cited CB&A Construction LLC for a willful violation and proposed $170,145 in penalties.
The company has 15 business days from receipt of the citations to comply, request an informal conference with OSHA’s area director, or contest the findings before the Occupational Safety and Health Review Commission. OSHA noted that penalties and citations may be modified as the case proceeds, and inspection updates will be reflected in the agency’s establishment search database.
The investigation was conducted under OSHA’s national emphasis program, which focuses enforcement resources on high-hazard industries to prevent serious injuries and fatalities. OSHA said employers can access compliance assistance resources and guidance on trenching and excavation safety through the agency’s website.
